1. Definitions
In these general terms and conditions, the following definitions apply:
- Javena: Javena, established in the Netherlands and registered with the Chamber of Commerce.
- Buyer / customer: any natural person or legal entity entering into an agreement with Javena.
- Agreement: any agreement between Javena and customer regarding the delivery of products and/or services.
- Products: all goods offered by Javena.
- Services: all activities, assembly, installation, advisory or other services offered by Javena.

2. Applicability
2.1 These general terms and conditions apply to all offers, orders, agreements, deliveries and services of Javena.
2.2 Deviations from these conditions are only valid if agreed upon in writing.
2.3 If one or more provisions of these conditions prove to be invalid, the remaining provisions shall remain fully in force.

3. Offer and Agreement
3.1 All offers and product information on the website are without obligation.
3.2 Obvious errors, mistakes, typographical or programming errors are not binding on Javena.
3.3 An agreement is concluded as soon as the customer has placed an order and received confirmation thereof from Javena.
3.4 Javena reserves the right to refuse orders or impose additional conditions.

4. Prices and Payments
4.1 All stated prices are in euros and include VAT, unless stated otherwise.
4.2 Shipping costs, assembly costs or other additional costs are stated separately.
4.3 Payment must be made immediately upon ordering, unless agreed otherwise in writing.
4.4 If payment is not made or not made on time, Javena reserves the right to suspend or cancel the agreement.
4.5 All delivered products remain the property of Javena until full payment has been made.

5. Delivery and Shipping
5.1 Javena strives to deliver orders as quickly as possible. Stated delivery times are indicative and not strict deadlines.
5.2 If delivery is delayed, the customer will be informed as soon as possible.
5.3 Deliveries take place at the delivery address provided by the customer.
5.4 The risk of damage to or loss of products passes to the customer at the time of delivery.
5.5 Javena is entitled to deliver orders in parts.
5.6 Javena may use reused packaging materials for shipping orders. This is done for sustainability reasons and to reduce waste.
5.7 If a customer selects an incorrect shipping method or provides incomplete information, Javena reserves the right to charge additional costs or cancel the order.

6. Right of Withdrawal and Returns
6.1 Consumers have the right to withdraw from an order within 14 days after receipt without stating a reason.
6.2 After notification of withdrawal, the customer has another 14 days to return the product.
6.3 During the withdrawal period, the customer must handle the product and packaging with care.
6.4 Return costs are at the expense of the customer, unless agreed otherwise.
6.5 Javena will refund the amount due within 14 days after receipt of the return shipment.
6.6 Excluded from the right of withdrawal are, among others:
- custom-made products;
- specially ordered products;
- products that cannot be returned for hygienic reasons if the seal has been broken;
- business orders for which the right of withdrawal is legally excluded.
6.7 In addition to the statutory right of withdrawal, Javena voluntarily offers a total reflection period of 30 days, provided that the product is returned unused, complete and in neat condition.

7. Warranty and Complaints
7.1 The customer must inspect products immediately upon receipt for visible defects or deviations.
7.2 Any complaints must be reported to Javena in writing or by e-mail within a reasonable period after discovery.
7.3 All products are covered by the statutory warranty.
7.4 Warranty lapses in the event of:
- improper use;
- incorrect assembly;
- damage caused by the customer;
- modifications or repairs carried out by third parties without permission from Javena.
7.5 If a product has been damaged during transport, the customer must retain the packaging materials so that any investigation by the carrier remains possible.
7.6 Javena will make every effort to handle complaints and warranty cases as carefully as possible.

8. Liability
8.1 Javena is only liable for direct damage resulting from intent or gross negligence.
8.2 Javena’s liability is in all cases limited to the amount of the relevant order or the amount paid out by the insurer.
8.3 Javena is not liable for indirect damage, consequential damage, loss of profit or damage resulting from improper use of products.
8.4 The customer remains responsible at all times for the correct application, assembly and use of delivered products.

9. Force Majeure
9.1 Javena is not obliged to fulfill obligations in the event of force majeure.
9.2 Force majeure includes, among other things:
- malfunctions;
- transport problems;
- strikes;
- government measures;
- illness;
- supplier problems;
- extreme weather conditions;
- technical failures.
9.3 During force majeure, obligations are suspended.

10. Copyright and Intellectual Property
10.1 All texts, images, designs, product information and other content on the Javena website are the property of Javena or its partners.
10.2 It is not permitted to copy, use or distribute content from Javena without written permission.

11. Privacy
11.1 Javena processes personal data in accordance with applicable privacy legislation.

12. Additional Provisions for Custom Work, Assembly and Installation
12.1 Additional conditions may apply to custom-made products, assembly work, installation or specialist deliveries.
12.2 The customer is responsible for:
- providing correct information;
- accessibility of the delivery location;
- sufficient space for delivery and installation;
- suitability of floors, walls and constructions.
12.3 If delivery or installation proves impossible due to circumstances at the location, additional costs may be charged.
12.4 For specialist products such as safes, storage solutions or security products, additional instructions may apply as stated on the website or quotation.

13. Disputes and Applicable Law
13.1 All agreements with Javena are exclusively governed by Dutch law.
13.2 Disputes shall preferably be resolved through mutual consultation.
13.3 If a dispute cannot be resolved mutually, it shall be submitted to the competent court in the Netherlands.
13.4 Complaints may also be submitted through WebwinkelKeur if applicable.

14. Final Provisions
14.1 Javena reserves the right to amend these general terms and conditions.
14.2 The most current version of the general terms and conditions is always available via the Javena website.
14.3 In situations not covered by these conditions, Javena shall decide in accordance with reasonableness and fairness.
